¿Te esforzaste por comprar un lugar donde vivir y queres protegerlo de los riesgos del mercado? ¿Queres pedir un credito pero no queres que tu vivienda sea la garantia? Encontra la Alternativa Legal para que tu vivienda este protegida y no pueda ser perjudicada por las deudas que tengas.

Desde 1934 la Ley  N° 14.394 preveía el instituto «bien de familia», conocido porque protegía la vivienda familiar. Una vez que estaba inscripto en en el Registro de la Propiedad Inmueble, la vivienda no podía ser vendida ni los acreedores por deudas posteriores a su inscripción podían cobrarse  de ella, ni aún en caso de concurso o quiebra.

Con la entrada en vigencia del Nuevo Código Civil y Comercial la Ley N° 14.394 quedó sin efecto y es común preguntarse si existe ahora algún instituto que proteja nuestra vivienda. Por supuesto que la respuesta es si: puede afectarse al régimen un inmueble destinado a vivienda.

El derecho a la vivienda es pilar fundamental en nuestro derecho, como así también se protege a la familia.

Lo que tenés que saber:

¿Cómo procede? Con su inscripción en el Registro de la Propiedad Inmueble.

¿Quién debe solicitar su inscripción? El propietario, si son varios todos ellos conjuntamente. El trámite se puede realizar personalmente o se puede contratar a un profesional.

¿Cuántas viviendas puedo inscribir? Solo una. No impide la inscripción que el propietario tenga más de un inmueble, pero debe optar solo por uno.

¿Cuáles son los requisitos? Habitación efectiva. Es decir, al menos algún familiar del propietario tiene que vivir en el inmueble (puede ser cónyuge, conviviente, hijos, padres, tíos, primos, sobrinos, etc.).

¿Para qué sirve? Para que los deudores no puedan cobrarse de la vivienda. Pero ojo, la deuda tiene que ser posterior a la inscripción para que tenga validez.

¿Excepciones? Las deudas que si pueden cobrarse de la vivienda son: expensas, impuestos, tasas, hipotecas, construcciones o mejoras sobre la vivienda, alimentos a favor de los hijos menores de edad del propietario.

¿Desventajas? Solo dos:

-Si el quien inscribe al momento de la inscripción estaba casada/o o convivía debe solicitar la autorización de su cónyuge o conviviente para vender la vivienda.

-Los inmuebles inscriptos como bien de familia difícilmente sean aceptados como garantía para solicitar un préstamo o para alquilar.

¿Honorarios? Si el trámite de constitución de un inmueble como bien de familia lo realiza un abogado, sus honorarios no pueden exceder el 1% de la valuación fiscal.

La Valuación Fiscal se encuentra en una boleta de Rentas (en Capital Federal) y de ARBA (en Provincia de Buenos Aires).
